The Cost of Hiring a Divorce Lawyer in Texas

It is normal to be very concerned about the cost of hiring a good lawyer. Everyone wonders about it, and it is an early topic of conversation when a potential client contacts our firm.

The short answer is: the more fighting in your case, the more it will cost. That said, most cases fall within a range based on the several factors outline below. We bill hourly like all attorneys but approach our billing in a way that is more transparent, honest and fair to you than other firms.

When you hire an attorney at our firm, you will be required to pay a retainer. This is an upfront fee that ranges in price according to the complexity of your case. This payment is then placed in your trust account. Your attorney’s hourly rate, along with any court costs or additional fees will be deducted from the trust. If, at the conclusion of your case, there are unused funds in your client trust, you will be refunded this amount.

Retainer fees usually range from $5,000 to $20,000. The retainer amount is set by the complexity of the client’s case and the level of conflict involved, as well as the client’s ability to pay ongoing fees.

Factors used to determine retainer fees generally include:

  • Whether or not there are children involved
  • The amount and type of assets involved in the divorce
  • The level of anticipated conflict in the case
  • Location, including the court/county where the case is filed
  • The opposing attorney
  • The likelihood that the client will pay in the future

  • Retainer Fee: Starting at $15,000 for divorces with kids and at $10,000 for other types of cases

  • Our non-attorney staff (i.e. paralegals, law clerks, and/or legal assistants) bill at hourly rates between $100 to $200/hr.

At Walters Gilbreath, PLLC, we strive to offer fair fees. We don’t nickle-and-dime you with petty charges like faxes (some lawyers still use these!). We do not inflate our billing with padded bills or minimum 15 or 30 minute increments. We have fair, transparent billing that we send out each month so that you know where you stand.

    You deserve direct and frequent communication with your attorney, not staff. As attorney practices grow, the usual reaction is to hire more staff. We’ve been guilty of the same thing in the past, but we learned and improved. The problem with this approach is attorneys get isolated from clients and spend most of their time managing the staff (at the client’s expense). We’ve now structured our offices so that you will be dealing with an attorney on all matters, not an employee of the attorneys.
