The Five Steps of Every Divorce

One of the first things you may be wondering if you are considering filing for divorce or have been served with divorce papers is how to begin. You’re also likely wondering how the process works and what you can expect at each stage. Believe it or not, there are five steps to just about every divorce and family law case.

The five steps include:

  • Filing the lawsuit
  • Obtaining a temporary order
  • Discovery
  • Mediation for final orders
  • Trial

In the state of Texas, you may file for divorce in the county where you live, so long as you have been living there for the past three months or more. You must also have been a Texas resident for at least six months prior to filing.

Next, you will most likely need to attend a temporary order hearing, unless you and your spouse can agree to temporary orders via mediation. Temporary order hearings are very important, as these orders often become permanent. The hearings themselves can contain surprises, as no discovery has yet occurred.

Discovery is the process of both parties exchanging information. This is meant to promote transparency and allow both parties to obtain a complete understanding of the extent of their estate in the event that they choose to settle the case. If an agreeable settlement seems feasible, the parties may attend mediation. This is the process of resolving conflicts outside of the courtroom. Mediation involves a specially trained mediator who helps the parties reach various agreements about the terms of the divorce.

If a settlement cannot be reached outside of the courtroom, the case will proceed to trial. During the trial, a judge or jury will make decisions regarding your divorce and a final order will be handed down. The final order is generally permanent, though modifications may be made at a later date should circumstances change.
