The Divorce Process in Texas
Generally speaking, all divorces go through the same five-step process.
The first step is filing for divorce. This can be done by either party in their county of residence, so long as they have been a resident of Texas for at least six months and lived in the county where they are filing for at least the past three months.
Next, the parties will likely be required to attend a hearing for a temporary order, which will be followed by the discovery process. Both of these steps are very important, as they involve the various aspects—such as the size of the estate, custody orders, etc.—that will ultimately be resolved in the final divorce order.
Following discovery, the parties may attend mediation to reach a final order. Mediation is only possible if the parties are able to compromise and come to an agreement on each element of the divorce. If this is not possible, the case will proceed to trial wherein a judge or jury will decide on each aspect of the divorce.
